These Terms of Use ("Terms") govern your use of Fluent African, operated by Glenfield Analytics Pty Ltd ("Fluent African", "we", "our", "us"). By creating an account, accessing, or using the service, you agree to these Terms and our Privacy Policy.
1. Eligibility and Accounts
- You must provide accurate registration information and keep it updated.
- You are responsible for activity performed through your account credentials.
- You must keep your login credentials secure and notify us of unauthorized access.
- Parent or guardian accounts are responsible for child profiles created under their household.
2. Platform Services
Fluent African provides family-focused language learning services, including teacher discovery, session booking, meet-and-greet requests, progress features, and prepaid lesson credit wallets. Service features may change over time.
3. Acceptable Use
You agree not to:
- Use the service for unlawful, abusive, or fraudulent activity.
- Attempt to bypass platform access controls or interfere with service integrity.
- Impersonate another person or misrepresent your identity, role, or qualifications.
- Harass, threaten, exploit, or endanger children, families, teachers, or staff.
- Solicit off-platform payments for platform-booked sessions.
- Upload malware, automate abusive traffic, or scrape data outside permitted use.
4. Teacher Relationship and Marketplace Integrity
Teachers are independent service providers. Fluent African is not an employer of teachers unless explicitly stated otherwise in a separate agreement. We may implement verification, moderation, and operational controls to maintain trust, safety, and service quality.
Platform bookings, wallet credits, and payment reconciliation are managed through platform systems. Direct side-payments that circumvent platform billing are prohibited for platform-arranged sessions.
5. Bookings, Session Lifecycle, and Credits
- Session bookings require valid account authorization and, where applicable, sufficient credits.
- Credits are reserved when bookings are created or amended.
- Credits may be consumed or released based on session lifecycle and attendance outcomes.
- Wallet balances and transaction history shown in-app are the primary operational record.
- Meet-and-greet sessions are free and subject to platform limits: one free meet-and-greet per parent-teacher pair, one meet-and-greet waiting or scheduled at a time, and a limited number of teachers a family may meet for free before completing its first paid lesson. A meet-and-greet that takes place, or that your family does not attend, counts towards these limits; one the teacher declines or does not attend does not.
6. Pricing, Payments, and Refunds
- Lesson credits are priced in US dollars (USD). Your card provider or payment method may present or settle the amount in your local currency; where the checkout shows a local-currency price, that is the amount you will be charged. Prices are displayed in-app and may be updated prospectively.
- Payments are processed by third-party payment providers. We do not store your card details.
- Purchased credits do not expire. Unused credits stay in your child's wallet until they are used, moved to a sibling, or refunded.
- Unused purchased credits that are not reserved for a booking are refundable on request. Refunds are made to the original payment method at the average price you paid per credit, so a discounted bundle is refunded at the discounted rate. Ask through support or close your account and we will refund the remaining balance.
- Referral programme: a parent who has completed at least one paid lesson may share a referral code. When a new family joins with that code, buys lesson credits and completes their first lesson, the referring parent receives free lesson credits as shown on the referrals page; the referred family receives no credit. One reward is paid per referred household. A referral is void if the qualifying purchase is refunded or disputed before the first lesson, if the code was used for the referrer's own household, or if we find the programme has been misused; a reward already paid may then be removed from unused free credits.
- We may add free lesson credits to a child's wallet, for example as a referral reward, a goodwill gesture or a promotion. Free credits have no cash value and cannot be refunded or exchanged for money. They are used before purchased credits when a lesson is booked, can be moved to a sibling, and may carry an expiry date that is shown with the credit. We may remove free credits that were obtained through misuse of a promotion.
- Credits consumed by a lesson that took place, and credits for a lesson cancelled inside the cancellation cutoff, are not refundable except where required by applicable law. If a lesson does not take place because the teacher did not start it, the credits are returned to your child's wallet automatically.
- If you believe a lesson was recorded incorrectly, you can report a problem from the lesson's history record within 7 days and our team will review it.
- If a payment is charged back or disputed with your card provider, the wallet funded by that payment is frozen: no new bookings can be made from it until the dispute is resolved. Credits from a payment that is reversed are removed, and any lessons already taken on those credits remain payable.
7. Child Safety and Conduct Standards
Child safety is a core platform requirement. Users must maintain respectful, age-appropriate communication and behavior at all times.
- No sexual, exploitative, harassing, threatening, or discriminatory conduct.
- No off-platform contact pressure or payment solicitation involving children or families.
- No sharing of private contact details for policy-violating communication purposes.
- Safeguarding concerns must be reported through official support channels.
8. Content, Feedback, and Communications
You are responsible for content you submit (for example profile details, feedback, and requests). You grant us a non-exclusive license to host, process, and display submitted content as needed to operate and improve the service.
If you provide product feedback or suggestions, we may use them without compensation, subject to applicable law.
9. Intellectual Property
The service, including platform software, branding, and original content, is owned by Glenfield Analytics Pty Ltd or its licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership rights to you.
10. Suspension and Termination
We may suspend, restrict, or terminate access where we reasonably believe there is misuse, policy breach, legal risk, safety risk, payment risk, or security risk.
You may stop using the service at any time. Certain obligations survive termination, including payment, dispute, safety, legal, and liability-related provisions.
11. Service Availability and Disclaimers
The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted service, specific outcomes, or absolute error-free operation.
12. Limitation of Liability
To the maximum extent permitted by law, Fluent African and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from your use of the service.
13. Indemnity
You agree to indemnify and hold harmless Fluent African and its personnel from claims, liabilities, damages, and costs arising from your misuse of the service, your breach of these Terms, or your violation of law or third-party rights.
14. Changes to Terms
We may update these Terms from time to time. The updated version is effective from the posted "Effective date" unless otherwise stated.
15. Governing Law
These Terms are governed by applicable laws of Australia, unless mandatory laws in your jurisdiction require otherwise.
